1. Acceptance of Terms

By accessing and using TerritoryCreator ("the Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

TerritoryCreator is a subscription-based platform that allows users to create, manage, and visualize geographic territories. The Service includes tools for territory management, assignment tracking, and geographic visualization.

3. Eligibility

You must be at least 13 years old to use the Service. By using TerritoryCreator, you represent and warrant that you meet this age requirement.

4. Account Registration

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. Subscription and Payment

Subscription fees are billed in advance according to your selected plan. All payments are processed securely through Stripe. You may cancel your subscription at any time through your account settings, and your access will continue until the end of your current billing period.

Refunds may be provided at our sole discretion. If you believe you are entitled to a refund, please contact us at support@territorycreator.com.

6. Your Content

You retain all ownership rights to the content you create using the Service, including your territories, assignments, and geographic data. By uploading content, you grant us a limited license to store, process, and display your content solely for the purpose of providing the Service to you.

You are responsible for ensuring you have the right to use any content you upload.

7. Intellectual Property

The Service, including its design, code, features, and branding, is owned by TerritoryCreator and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service.

8. Prohibited Uses

You may not use the Service:

• In any way that violates applicable laws or regulations
• To upload content that infringes on the intellectual property rights of others
• To transmit malware, spam, or other harmful content
• To attempt to gain unauthorized access to the Service or other users' accounts
• To impersonate TerritoryCreator, its employees, or other users

9. Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these Terms or engage in conduct that we determine, in our sole discretion, to be harmful to the Service or other users.

You may delete your account at any time through your account settings or by contacting us.

10. Data Retention

If you cancel your subscription, we will retain your content for 90 days, during which time you may resubscribe to regain access or contact us to export your data. After 90 days, your content may be permanently deleted.

If you request account deletion, we will delete your account and associated content within 30 days.

11. Service Availability

We strive to maintain reliable service, but we do not guarantee that the Service will be available at all times. We may modify, suspend, or discontinue any part of the Service at any time without prior notice.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.

13. Limitation of Liability

To the maximum extent permitted by law, TerritoryCreator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless TerritoryCreator and its owners from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

15. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Ohio, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the state or federal courts located in Ohio.
